Guardianship/Special Needs Trust

Guardianships for Families of Special Needs Children

When a special needs child turns 18, he or she becomes an adult in the eyes of the law. That means they have the right to make their own decisions about their medical treatment, finances, and life choices. Unfortunately, many children with severe special needs lack the legal competency to manage their own affairs effectively, understand the decisions they must make, or appreciate the consequences of those decisions. I have helped many families of severely disabled children navigate the often very complex rules and regulations in those situations, including:

  • Powers of Attorney;
  • Court Ordered Guardianships; and
  • Special Needs Trusts.

What is Guardianship?

Guardianship is a legal proceeding in which someone asks the court to find that a person is unable to manage his or her affairs effectively because of a disability. A guardian steps in the shoes of the person with a disability and makes the decisions for them.

The process to set up a guardianship can be long and expensive and is not a decision to be taken lightly. I can guide you through the legal process of guardianship and your options once your child turns 18.
